These terms apply to the Haldex.Flash mobile app, the licences you use with it and the tune files it delivers. By creating an account, buying a licence or using the app you agree to them. If you do not agree, please do not use the app.
The three things to know before you start:
- A licence is tied to one vehicle permanently once you assign it. It cannot be moved to another vehicle or another person.
- A licence can be refunded within 14 days of purchase only while it is unassigned. Once assigned it is non-refundable.
- Flashing rewrites a drivetrain control unit. You do it at your own risk, and it may affect your warranty, insurance and road legality.
1. Who we are
The app and the service behind it are provided by Road Rage Performance Ltd ("we", "us"), a company registered in England and Wales with company number 10542607. Registered office: Unit D5 D6 Forstal Business Park, Paddock Wood, Tonbridge, England, TN12 6PY.
You can contact us at info@roadrageperformance.co.uk.
2. What the app does
The app connects to a compatible OBD adapter over Bluetooth and lets you read, flash, monitor and live-tune the Haldex all-wheel-drive control unit or VAQ electronic differential control unit on supported Volkswagen Audi Group vehicles.
It is intended for enthusiasts and professionals who understand vehicle tuning. It is not a diagnostic or repair tool, and it will not fix a mechanical fault.
3. The app, licences and adapter are separate
- The app is free to download. On its own it does not let you flash a vehicle.
- A licence is needed for each vehicle you want to flash or tune. Licences are sold separately, by us or by an authorised dealer, and are not bought through the App Store or Google Play.
- The OBD adapter is physical hardware, sold separately. Its sale is covered by the terms of the shop you buy it from.
Downloading the app does not entitle you to a licence or an adapter, and buying one does not include the other.
4. Your account
- You need an account to use the app. You must give accurate details and keep your password to yourself.
- You can use your account as soon as you register. Dealer accounts are approved by hand before they can be used. We may decline, suspend or close an account at our discretion without giving a reason.
- You are responsible for everything done through your account. Tell us straight away if you think someone else has access to it.
- We may suspend or close an account that is used in breach of these terms.
5. Licences are locked to one vehicle
When you assign a licence in the app, it is bound to that vehicle's VIN for good. The app warns you before you confirm. After that:
- the licence cannot be moved to a different vehicle, including if you sell the vehicle, write it off or replace the control unit with one from another car;
- you cannot transfer, resell or lend the licence to another account. A licence changes account only when we or the dealer who sold it transfer it, or when the vehicle's owner claims it from the app after the account holding it has been deleted;
- tune files delivered under the licence are locked to that VIN and will not work on any other vehicle.
Check the VIN shown in the app carefully before you confirm. We cannot undo an assignment made to the wrong vehicle.
A licence gives you a personal, non-exclusive right to use our software and tune files on the assigned vehicle. We keep all ownership and intellectual property rights in them.
6. Refunds and cancellation
- Unassigned licences. You can cancel and get a full refund within 14 days of purchase, provided the licence has not been assigned to a vehicle. Email info@roadrageperformance.co.uk from the address on your account.
- Assigned licences. Assigning a licence starts the supply of digital content. By assigning it you ask us to begin straight away and accept that you lose the right to cancel. Assigned licences are non-refundable.
- Licences bought from a dealer. Your contract of sale is with the dealer, so refund requests go to them.
None of this affects your legal rights if what we supply is faulty or not as described.
7. Risks of flashing
Flashing rewrites the software on a control unit that manages your vehicle's drivetrain. By using the app you accept that:
- an interrupted or failed flash can leave a control unit unresponsive and in need of recovery or replacement;
- a tuned calibration places more demand on the pump, clutch pack, differential and related parts than the factory software does, and can speed up wear or expose an existing weakness;
- modifying control unit software may invalidate all or part of your vehicle manufacturer's warranty or any extended warranty;
- you may need to tell your insurer about the modification, and failing to do so could affect your cover.
You use the app, and apply any tune, entirely at your own discretion and risk.
8. Before you flash, and afterwards
You are responsible for making sure that:
- the differential, pump, motor and associated components are in sound working order, with no existing faults;
- the vehicle battery is healthy and supported by a suitable charger where needed, and the phone has enough charge to finish;
- the adapter stays connected and the app stays open until the flash completes;
- you follow the instructions in the app.
A tuned system needs looking after. We recommend a full Haldex service, including fluid and filter and an inspection of the pump, every 10,000 miles. We are not liable for problems that come from poor maintenance.
9. Road legality
Rules on vehicle modification differ from country to country. It is your responsibility to make sure that a modified vehicle is legal to use on the road where you drive it, that it meets any inspection or type-approval requirements, and that live tuning features are used safely and lawfully. Do not operate the app while driving.
10. Custom tune files
Where the app lets you load a tune file that you, a dealer or anyone else has supplied, that file is not ours. We have not created, tested or approved it, and we accept no responsibility for what it does to your vehicle. You load custom files entirely at your own risk, and you must have the right to use any file you load.
11. What you must not do
- Copy, modify, decompile or reverse-engineer the app, the adapter firmware or our tune files, or try to get around the VIN lock or licence checks.
- Share, sell or distribute tune files obtained through the app.
- Use the app on a vehicle or control unit it is not intended for.
- Use the app on a vehicle you do not own or have permission to modify.
12. Support and diagnostic reports
We offer support for installing and using the app. To help us investigate a problem you can choose to send a diagnostic report from the app. What a report contains and how we handle it is described in our Privacy Policy.
13. Updates and availability
We may update the app from time to time, including through over-the-air updates that install without a visit to the app store. Some updates may be required before the app will keep working. We aim to keep the service available but do not promise that it will be uninterrupted or error-free, and flashing needs a working internet connection for licence checks.
14. Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law. If you are a consumer, your statutory rights are not affected.
Subject to that, and to the fullest extent the law allows:
- we are not liable for damage to your vehicle or its components arising from use of the app, a flash or a tune, including damage caused by existing faults, poor maintenance, an interrupted flash, or failure to follow the instructions;
- we are not liable for loss of warranty, increased insurance costs, fines, or a vehicle being found not road legal;
- we are not liable for anything caused by a custom tune file or by hardware or software we did not supply;
- we are not liable for indirect or consequential loss, or for business losses such as lost profit or lost opportunity;
- our total liability to you in connection with a licence is limited to the price paid for that licence.
15. Closing your account
You can delete your account at any time from within the app or by emailing us. A licence already assigned to a vehicle stays with that vehicle, but you will no longer be able to manage it from the deleted account. Unused licences are lost when the account is deleted, so ask for any refund you are entitled to first. The Privacy Policy explains what happens to your data.
16. Changes to these terms
We may update these terms. The date at the top shows when they last changed. If a change is significant we will tell you in the app or by email before it takes effect.
17. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK you can also bring a claim in the courts where you live.
18. Contact
Questions about these terms can be sent to info@roadrageperformance.co.uk.
